These Terms and Conditions (hereinafter, the "Terms") govern access to and use of the digital platform of Qentiva S.A.S. (hereinafter, "Qentiva" or "the Platform"), with legal domicile at Av. del Libertador 6250, Floor 8, Office B, C1428ARS, Buenos Aires, Argentina. Tax ID (CUIT): 30-72198456-3.
1. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you disagree with any of these conditions, we ask that you do not use the Platform. Continued use of the site after the publication of modifications implies your acceptance of the updated Terms.
2. Service description
Qentiva operates a real estate crowdlending platform that facilitates the connection between individual investors and real estate project developers in Argentina. The Platform allows users to explore projects, obtain information about investment opportunities, and contact our team. Qentiva does not act as a financial entity regulated by the Central Bank of Argentina (BCRA) or as a capital market agent regulated by the National Securities Commission (CNV).
3. Usage requirements
To use the Platform you must: • Be at least 18 years old and have legal capacity to enter into contracts under Argentine law. • Provide truthful, complete, and up-to-date information. • Not use the Platform for illegal purposes or purposes contrary to these Terms. • Not attempt to access restricted areas of the site or interfere with its operation.
4. Investment risks
Real estate crowdlending involves inherent risks that the user must consider before participating in any project: • Capital loss risk: There is a possibility of losing all or part of the invested capital. • Illiquidity risk: Investments in real estate projects may have extended timeframes, and it is not always possible to recover funds early. • Construction risk: Projects may experience delays, cost overruns, or changes in original conditions. • Regulatory risk: Changes in Argentine regulations or macroeconomic conditions may affect project results. Qentiva does not guarantee specific returns or the repayment of invested capital. Past returns do not constitute a guarantee of future results. We recommend seeking independent financial advice before making investment decisions.
5. Intellectual property
All content published on the Platform — including texts, graphics, logos, icons, images, designs, source code, and software — is the property of Qentiva S.A.S. or its licensors and is protected by Argentine intellectual property laws (Law No. 11,723) and international treaties. Reproduction, distribution, modification, or any unauthorized use of the content without prior written consent is prohibited.
6. Limitation of liability
Qentiva provides the Platform "as is" and "as available". To the maximum extent permitted by Argentine law: • We do not guarantee that the Platform will be free of errors, interruptions, or viruses. • We are not responsible for investment decisions made based on information published on the Platform. • Our total liability to the user shall not exceed the amount of commissions effectively paid by the user in the last 12 months. • We shall not be liable for indirect, incidental, special, or consequential damages.
7. Use of the contact form
The contact form available on the Platform is for informational and general communication purposes. Submitting a message does not create any contractual obligation on the part of Qentiva. We reserve the right to respond or not to received inquiries at our discretion and operational capacity.
8. Applicable law and jurisdiction
These Terms are governed by the laws of the Republic of Argentina. Any dispute arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the Commercial Courts of the City of Buenos Aires, the parties waiving any other forum or jurisdiction that may correspond to them.
9. Modifications
Qentiva reserves the right to modify these Terms at any time. Modifications will take effect from their publication on the Platform. Continued use of the site after the publication of changes constitutes acceptance of the new Terms.
